In compliance with Federal Data Protection Law(hereinafter the “Law”), its Regulations (hereinafter the “Regulations”) and the Guidelines for the Privacy Notice (herein after the “Guidelines”), we hereby inform you that Gran Armee del Cabo, S.A. de C.V. and Concorde Development, S.A.P.I. de C.V. con with address in Predio Paraíso Escondido s/n,  C.P. 23450, Cabo San Lucas, Baja California Sur, México, and/or its affiliates or subsidiaries (hereinafter together known as the “Responsible”), are the responsible for collecting, processing and protecting your personal data.
 
In this regard, we inform you the following:
 
PURPOSES OF PROCESSING YOUR PERSONAL DATA
 
The personal information that we collect from you will be used for the following purposes that are necessary for the products or services that you request from us: to make it possible for you to buy and build property in Rosewood Residences Old Lighthouse Los Cabos, to formalize and carry out your residential purchase transaction, to facilitate the closing of your purchase, to help you settle into and enjoy your property and to comply with obligations derived from our relationship with you, including with anti-money laundering laws and regulations.
 
Contact and send information to let you know commercial information of the Responsible, among which is related to opening date, type of services and products offered, events and changes in products and/or services.
 
We may also use your personal information for secondary purposes such as for market research and product development so we can understand your needs as a home buyer. If you do not wish that we use your personal information for these secondary purposes, please send an email to info@oldlighthouse.com
 
PERSONAL DATA TREATED
 
To carry out the purposes set forth in this privacy notice, we will use the identification, contact and financial personal information that you provide to us electronically, in writing or verbally. The Responsible do not collect or process sensitive personal information.
 
The personal data requested may include names, marital status, certificate of marriage, nationality, gender, profession, addresses, telephone numbers, e-mail addresses, office identification, proof of tax status, proof of address, financial data, bank account information, payment methods, taxpayer identification number (RFC), credit history, and billing information,
 
TRANSFER OF PERSONAL DATA
 
Through your signature hereunder, you hereby consent to the processing and transfer of your personal information to Rosewood Hotels and Resorts, L.L.C. or any of its affiliates or subsidiaries.
 
LIMITATION OF USE AND DISCLOUSRE / EXERCISE OF ARCO RIGHTS/
REVOCATION OF CONSENT
You have the right to know what personal information we have concerning you and for what purposes we use it (Access); request the rectification of your personal information in case itis outdated, inaccurate or incomplete (Rectification); be removed from our database when you consider it is not being used in accordance with applicable laws (Cancellation); and to oppose to the use of your personal information for specific purposes (Opposition). These rights are known as ARCO rights.
 
You may exercise your ARCO rights by emailing your request to info@oldlighthouse.com. Your request should contain at least the following information: (i) full name and email address; (ii)copy of a currently valid official (government issued)identification; (iii) a clear description of the personal information with respect to which you seek to exercise the foregoing rights; (iv) a clear description of the rights you seek to exercise; (v) if applicable, complete name of your legal representative, copy of a currently valid official (government issued) identification of the legal representative and copy of the public deed or letter signed in the presence of two witnesses evidencing such representative’s authority; and (vi) any other element or document that may facilitate the location of your personal information. In the case of a request for rectification, you should indicate the modifications to be made and accompany the documentation supporting your request. In case the information provided in the request is insufficient or erroneous, or if the necessary documentation is not attached thereto, within five (5) business days following receipt of your request, we may request you to provide the necessary information or documents in order to process your request. You will have a period of ten (10) business days to respond to the request, counted as of the day following the date you received our request. If you do not respond within such term, your request will be dismissed. We will inform you the resolution adopted within a maximum term of twenty (20) business days counted as of the date we receive your request (or, if applicable, the day following the date you respond to our request of information), in order to, if admissible, make it effective within fifteen (15) business days following the date we inform you our response. Our response will be sent by email to the email address identified in your request. The foregoing periods of time may only be extended as permitted by law.
 
LIMITATION OF USE AND DISCLOSURE / REVOCATION OF CONSENT
 
For purposes of limiting the use or disclosure of your personal data, likewise to express your denial to process data and revoking your consent, you must file a request by emailing our privacy officer at info@oldlighthouse.com  same request that must contain: (i) name and address or other means to communicate the response to your request; (b)documents that prove your identity or, where appropriate, legal representation; (c) clear and precise description of the right that you desire to exercise; (d) in case of revocation of consent, the express consent to revoke your consent for processing your personal data and therefore, to suspend its use; and (e) any other element that eases the location of your personal data.
 
MODIFICATIONS TO THE PRIVACY NOTICE
 
This privacy notice may by modified and is subject to changes and/or updates resulting from new legal requirements; our own needs for products or services we offer; of our privacy practices; changes in our business model, or other causes.
 
We agree to keep you informed about the changes to our privacy notice.
 
Modifications will be duly informed through: (i)any other oral, printed or electronic communication means that the Responsible deem appropriate for such purpose, and/or (ii) the Responsible will send them to your last email you have provided.
 
SECURITY MEASURES
 
In order to assure proper protection of your personal data and to fully comply with the Law, its Regulations and the Guidelines, we inform you that the Responsible have implemented administrative, technical and physical security measures for the correct protection of your data.
